These Terms do not create a client or service relationship between you and Fonda AI. If you become a client, a separate service agreement will govern that relationship.

While we strive for accuracy and helpfulness, AI-generated communications may occasionally contain errors or inaccuracies. AI-powered communications are not a substitute for professional advice, and you should not rely on them for critical business, legal, or financial decisions.

5.3 Canada’s Anti-Spam Legislation (CASL) Compliance

We comply with Canada’s Anti-Spam Legislation (CASL), S.C. 2010, c. 23, in all electronic communications. In accordance with CASL:

• We will only send you commercial electronic messages (CEMs) where we have your express consent or where implied consent exists under CASL
• All commercial electronic messages will clearly identify Fonda AI as the sender and include our contact information

5.4 Text Messaging Terms

By providing your mobile phone number and consenting to receive text messages, you additionally agree to the following:

• Message frequency will vary depending on your interactions and inquiries
• Message and data rates may apply depending on your mobile carrier and plan
• You can opt out of text messages at any time by replying STOP to any message
• For help or questions about text messaging, reply HELP to any message or contact us at the information provided in Section 15
• Text messaging is not required as a condition of purchasing any goods or services from Fonda AI
• We will not share your phone number with third parties for their marketing purposes

Supported carriers include, but are not limited to, major Canadian carriers. Fonda AI is not responsible for delayed or undelivered messages caused by carrier issues or device incompatibility.

5.5 Withdrawing Consent

You may withdraw your consent to receive communications from Fonda AI at any time by:

• Replying STOP to any text message
• Clicking the "unsubscribe" link in any email
• Contacting us directly using the information in Section 15

Withdrawal of consent will be processed promptly. Please note that even after opting out of marketing communications, we may still send you transactional or administrative messages related to your existing interactions with us, where permitted by law.

6.1 Availability

6.2 Trial and Demo Terms

6.3 No Obligation

Accessing a product trial, demo, or tool does not obligate you to purchase any services from Fonda AI, nor does it create a client relationship. Similarly, participation in a trial or demo does not obligate Fonda AI to offer you any specific services or pricing.

6.4 Data from Trials and Demos

Any data, information, or content you input into a product trial, demo, or interactive tool may be processed by AI systems and stored by Fonda AI. We use this data to provide the trial or demo experience, improve our products and services, and follow up with you as described in Section 5. We will handle all such data in accordance with our Privacy Policy and PIPEDA.

6.5 No Warranties on Trials

Product trials, demos, and tools are provided “as is” and “as available” without warranties of any kind. AI-powered features may produce inaccurate, incomplete, or unexpected results. You should not rely on trial or demo outputs for business, legal, financial, or other critical decisions.

7. Intellectual Property

7.1 Our Content

All content on the Site, including but not limited to text, graphics, logos, images, videos, software, AI models, tools, code, designs, and the overall look and feel of the Site, is the property of Fonda AI or its licensors and is protected by Canadian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Site content without our prior written consent.
